A job site rental is a different job than an event rental: the unit stays for weeks or months, a service truck has to reach it on a schedule, and a federal rule — not a guess — sets the minimum count. The count comes from OSHA’s table
For construction sites, 29 CFR 1926.51(c)(1) Table D-1 is the rule that sets the toilet minimum. It is reproduced here as OSHA publishes it — including the way the federal table lists “20” in two rows:

Two provisions travel with the table. Where a sanitary sewer is not available, 1926.51(c)(3) lists the allowed toilet types unless local codes prohibit them. And under 1926.51(c)(4), mobile crews with transportation readily available to nearby toilet facilities are exempt from the onsite requirement.

The “one per 10 workers” figure is servicing guidance
The one-unit-per-10-workers figure that circulates in the trade comes from OSHA’s May 17, 2006 interpretation letter, which cites ANSI Z4.3-1995 as servicing guidance for a 40-hour week — it is not a second federal count. The same letter is where OSHA states its position that a toilet present but too unsanitary to use is not “provided” at all. That makes the pump-out schedule part of compliance, not a comfort upgrade.

The lavatory rule is separate
29 CFR 1926.51(f)(3) requires construction lavatories with running water, a cleansing agent, and towels or a dryer, subject to the listed exception for mobile crews and normally unattended work locations. What noncompliance costs in 2026
OSHA’s May 21, 2026 penalty memo kept 2025 maximums in place for 2026: a Serious violation runs $1,085 to $16,550; Repeat and Willful violations reach $165,514; failure to abate runs up to $16,550 per day, generally limited to 30 days. The July 14, 2025 Field Operations Manual revision expanded small-employer penalty reductions — the 1–25 employee category can now see up to a 70 percent reduction — but a reduction is not an exemption.

- Peak crew size on site, not total payroll
- Project start, expected length, and whether phases change the crew
- Where a service truck can stop, and the surface between truck and unit
- Whether the site is fenced or gated, and how the driver gets in
- Whether ADA-exempt construction-personnel use applies, or the public is present

How many units does OSHA require on my job site?
OSHA Table D-1 at 29 CFR 1926.51(c)(1) sets the minimum: one facility for 20 or fewer workers; one toilet seat and one urinal per 40 workers at 20 or more; one toilet seat and one urinal per 50 workers at 200 or more. Count the workers actually on site at peak, not the payroll. The often-quoted one unit per 10 workers figure is servicing guidance from a 2006 OSHA interpretation letter, not a second federal count.
Does a long project change the rental?
Yes. Long placements are usually billed by a recurring period with a service visit included, and the service schedule matters as much as the unit count. A unit that is on site but unusable does not count as provided in OSHA's view, so pump-out frequency for your crew size is worth settling before delivery.
Do I need handwashing stations too?
